Introduction

This Privacy Policy governs the collection, use and disclosure of personal information by Examify Inc. ("Examify" or "we" or "our"). In compliance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable legislation, this Privacy Policy is designed to provide transparency regarding our privacy practices with respect to the use and disclosure of the personal information we collect from you when you use Examify services.

This Privacy Policy is effective as of August 3, 2020. It was last updated on February 2nd, 2021. We may update this policy from time to time to meet Canadian privacy laws and standards. Your continued use of Examify services following the posting of changes to this Privacy Policy will signify your acceptance of those changes.

What information we collect and why

For students:
Information your course instructor provides to us, such as your email address and course enrollment
  • To email you an invitation to register for the course on Examify
  • To allow course instructors to identify you when marking your exams
Information you provide, such as your name and account password
  • To provide you with Examify services, including login and authentication of your account and access to your exams
  • Name is provided to course instructor to identify you when marking your exams
Information gathered during the exam, such as your answers to the exam questions and time spent per question
  • Provided to the course instructor to mark your exam
  • Creation of exam analytics viewable by the course instructor
For all website visitors:
The IP address of the computer that contacted the website, date & time of the visit, and pages visited
  • This information is collected by software known as a rate limiter. It is used solely to monitor network traffic and block unauthorized attempts to compromise our website

How long your information is retained for

We retain your personal information for a reasonable amount of time necessary to fulfill the identified purposes or as permitted or required by law. We may keep your personal information until you delete your account or let us know that you no longer require Examify services.

Where your information is stored

Our company is located in Canada but we use service providers located in Canada as well as the United States. This means that your personal information may be processed and stored in those countries and therefore may be subject to disclosure under the laws of those jurisdictions. When we send your information across borders, we take steps to protect your information, and we take all reasonable steps to only send your information to countries that have strong data protection laws.

When and why we share your information with others

If you are a student using Examify's services, we may disclose your personal information, including your name, email address and exam answers, to the course instructor for the purpose of administering and marking exams.

We may rely on third parties to help us provide you with Examify services and share some of your personal information with these companies. If we share your information with such third parties, we will ensure your information receives the same level of protection as it does under this Privacy Policy.

We may disclose your personal information to other third parties in relation to a merger, acquisition, or any form of sale of some or all of our assets or business. Your information may be provided to the entities and advisors involved, for the purposes of determining whether to proceed with the transaction and, where applicable, to conclude the transaction. Your information may be transferred to a successor or assign of all or part of our assets or business that may use and disclose the information for the purposes described in this Privacy Policy.

We may also disclose your information for other purposes, with your consent or to the extent necessary for the purposes of meeting relevant regulatory, legal, insurance, audit, security and processing requirements, or to the extent permitted or required by applicable laws.

How we protect your information

We are dedicated to protecting your personal information and ensuring the security of our software platform. This is why we use a secure server hosting location, firewall protection, controlled access and standard secure data storage practices to protect your personal information. We meet and exceed industry standards, such as the National Institute of Standards and Technology (NIST) guidelines for storing passwords, to ensure your information is secure. We also limit access to your information to employees who we believe reasonably need to come into contact with that information to provide Examify services to you or in order to do their jobs. While no system is guaranteed to be completely secure, we work hard to ensure our security measures protect all information in a responsible manner.

How we use cookies and other tracking technologies

A cookie is a text file that is placed on your hard disk by a Web page server, often including an anonymous unique identifier. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

We primarily use session cookies to help improve your browsing experience on the website.

Examify users can control and manage cookies in various ways. Your rights over your information

You own your personal information. By using Examify services and providing your personal information, you consent to your information being collected, used, disclosed and stored by Examify, only as described in this Privacy Policy. You are welcome to make changes and request deletion or corrections to your personal information at any time by contacting us at the email listed below.

At any time and without penalty, you can withdraw your consent to the use and disclosure of your personal information as set out in this Privacy Policy and have your account deleted by contacting us at the email listed below.

Please note that if you send us a request relating to your personal information, we have to verify your identity before we can respond. In order to do so, we may ask to see documentation, which we will discard after verification.
